Türk Hukukunda Velayetin Çocuğun Sosyal Güvenlik Hakkına Etkisi

Abstract
Aile hukuku alanında velayet kurumunu, sosyal güvenlik hukuku alanında ise sosyal güvenlik hakkını inceleyen akademik çalışmalar mevcuttur. Ancak, söz konusu iki alanın kesişim noktasını oluşturan velayet kurumu ile çocuğun sosyal güvenlik hakkı arasındaki ilişkinin henüz akademik bir çalışma kapsamında ele alınmadığı görülmektedir. Oysa çocuğun sosyal güvenlik hakkından yararlanmasının velisinin işlemlerine bağlı olması, uygulamada çeşitli sorunlara yol açabilmektedir. Bu sorunların ortaya konulması ve bunlara ilişkin çözüm önerileri sunulması önem arz etmektedir. Bu çerçevede, bu çalışmada velayetin çocuğun sosyal güvenlik hakkına etkisi ele alınacaktır.

Abstract
There are academic studies examining the institution of custody in the field of family law and the right to social security in the field of social security law. However, it is observed that the relationship between the institution of custody and the child's right to social security, which is the intersection of these two fields, has not yet been addressed in an academic study. Yet, the fact that the child's entitlement to social security depends on the actions of the legal guardian can lead to various problems in practice. It is important to identify these problems and propose solutions. In this context, this study examines the impact of custody on the child's right to social security.
