ÇALIŞMA HAYATINDA ŞİDDET VE TACİZ

Abstract
Toplumsal cinsiyete dayanan şiddetin finansal ya da ekonomik olarak; aile içi şiddetin ise ayrımcılık ile birlikte incelenmesi gerektiği konusunda genel bir kanı bulunmaktadır. Çalışma hayatında “şiddet” kavramı, Uluslararası Çalışma Örgütü’nün kabul ettiği şekilde ele alındığında, çoğunlukla fiziksel ve psikolojik şiddet ve tacizi, bazen de cinsel şiddet ve tacizi kapsamaktadır. Çalışmamızda, ülke farklılıklarını dikkate alarak, şiddet ve taciz kavramlarını birlikte kullanmayı uygun gördük. Bu nedenle bu çalışma, şiddet ve tacizin sınıflandırılmasına yönelik hazırlanmıştır. Şiddet ve tacizin etkileri ve etkenleri, inceleme konumuz kapsamına alınmıştır. İncelememizde son olarak, şiddet ve tacizi önlemeye ilişkin görüşlere yer verilmiş ve yaptırımlar üzerinde durulmuş; ispat yükü ve mağdura destek, koruma gibi kavramlar ele alınmıştır. Özellikle “ onarıcı adalet” kavramı işlenmiştir.

Abstract
Gender-based violence is either financial or economic, while domestic violence is a common issue that needs to be addressed together with discrimination. Considering its accepted definition by the International Labour Organisation, the term “violence” in working environment includes physical and psychological violence and harassment, and sometimes sexual violence and harassment. Considering country differences, we find it useful to discuss the concepts of violence and harassment together. This study is therefore on the classification of violence and harassment. The root causes of violence and its effects are also elaborated in this study. Last but not least, some remarks on how to prevent violence and harassment are also provided and criminal sanctions are emphasised. In addition, concepts, such as burden of proof, support to the victims of a crime, and their protection are also discussed. In particular, “reparative justice” is reviewed in this study.
